These Terms of Service ("Terms") govern your use of the OUTMARK mobile application ("App") operated by OUTMARK ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
OUTMARK is a GPS field-logging tool intended for hunters, anglers, and outdoorsmen. You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:
You must create an account to use social features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been compromised.
Certain features of OUTMARK require a paid subscription. Subscriptions are billed through the Apple App Store and are subject to Apple's payment terms. Subscription fees are non-refundable except as required by applicable law or Apple's refund policy. You may cancel your subscription at any time through your Apple ID account settings; cancellation takes effect at the end of the current billing period.
You retain ownership of the GPS pins, notes, and other content you create in OUTMARK ("Your Content"). By sharing content with other users through the People feature, you grant those users a limited, non-exclusive right to view and import that content. We do not claim ownership of Your Content and will not use it for any purpose beyond operating the App.
OUTMARK requests access to your device's location to provide its core functionality. Location data is stored locally on your device. Precise GPS coordinates are transmitted to our servers only when you explicitly choose to share a pin with another user. You may revoke location permission at any time through your device's settings, though doing so will disable core app features.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
OUTMARK is a supplemental tool. It is your responsibility to comply with all applicable hunting, fishing, and land-use laws and regulations. Do not rely solely on the App for navigation or safety decisions in the field.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
We reserve the right to suspend or terminate your account and access to the App at our discretion if you violate these Terms or engage in conduct we determine to be harmful to other users or the App. You may delete your account at any time by contacting us.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict of law principles.
